Attempts to contain judicial activism in the Inter-American Court of Human Rights

Abstract


The judicial activism resulting from the actions of some judges of the Inter-American Court of Human Rights can be detrimental to the legitimacy of the inter-American system and should be contained in order to limit harmful effects. While judicial activism is present both domestically and internationally, in the national context there are mechanisms that can control its negative effects, for example, the system of checks and balances represented by the tripartite division of powers. In the international context, such restraint could only be accomplished through a linkage of the performance of such courts to the capabilities conferred by the sovereign member States. In other words, the judge of the Inter-American Court of Human Rights does not have unfettered freedom to deliver their decisions and its decide power is limited by the application and interpretation of the agreements ratified by the member states of the Convention. Accordingly, this paper begins with the analysis of the activism and the legalization of politics in the broadest sense, making a comparative study of the causes and limits of this activism on the national and international level, and then analyze the effects of this practice and how it can be contained especially in the international context.
