Problemas e distinções relativos à jurisdição, admissibilidade e direito aplicável em Tribunais Internacionais

Resumo


Jurisdição, admissibilidade e direito aplicável são três conceitos jurídicos encontrados na prática de todas as cortes e tribunais internacionais. Embora conceitualmente próximos e por vezes até mesmo sobrepostos, cada um dele possui características e definições específicas a partir das regras que regem o funcionamento de cada órgão judicial internacional. O objetivo deste ensaio é investigar como os três conceitos podem ser definidos a partir de princípios e regras gerais de direito internacional e das regras aplicáveis à operação de tribunais e cortes internacionais em particular. Apresenta-se as definições, diferenças e semelhanças entre os conceitos sob a perspectiva de cortes e tribunais internacionais, assim como demonstrar como eles são operacionalizados pelos órgãos judiciais internacionais existentes de acordo com seus instrumentos constitutivos e as regras desenvolvidas em seus respectivos corpos jurisprudenciais, com especial foco na jurisprudência da Corte Internacional de Justiça. Sustenta-se que as três noções são diretamente conectadas e podem, inclusive, se sobrepor em determinados procedimentos. Entretanto, a principal fonte para a delimitação de cada um dos conceitos são as regras estatutárias que regem cada tribunal específico e que operam como lex specialis em relação a outros princípios e regras insurgentes a partir do direito internacional geral.
